How does cmte accomplish its purpose?*The Panel, pursuant to 10 U.S.C § 118(f), shall provide the Committees on the Armed Services of the Senate and House of Representatives an assessment of the Department of Defense’s Quadrennial Defense Review. The Panel is not subject to FACA and the charter has been withdrawn.
How is membership balanced?*The Panel shall be comprised of no more than twelve members appointed by the Secretary of Defense, and shall be bipartisan. The Secretary of Defense shall appoint Panel members to serve for the duration of this Quadrennial Defense Review; and those members, who are not full-time or permanent part-time federal employees, shall be appointed as experts and consultants under the authority of 5 U.S.C. § 3109 and serve as Special Government Employees. The Secretary of Defense shall appointed two co-chairmen from the twelve members appointed, and these individuals shall be divided equally on a bipartisan basis. Any vacancy in the Panel shall be filled in the same manner as the original appointment and, with the exception of travel and per diem for official travel, Panel members shall serve without compensation. The Panel is not subject to FACA and the charter has been withdrawn.

Why advice can't be obtained elsewhere?*The committee is directed by Act of Congress -- 10 U.S.C. § 118(f). The Panel is not subject to FACA and the charter has been withdrawn.
Why close or partially close meetings?Meetings are not closed to the public unless the Department of Defense determines that items on the planned agenda meet the closed meeting provisions of 5 U.S.C. § 552b(c). Pursuant to DoD policy closed meetings can only be authorized by the DoD Sponsor, who is the Under Secretary of Defense for Policy or designee, and only after consultation with the Office of the DoD General Counsel. The Panel is not subject to FACA and the charter has been withdrawn.
Recommendation RemarksSubsequent to chartering this advisory committee the Departement of Defense, in consultation with GSA and DoD OGC, determined that the advisory committee was not subject to the provisions of the Federal Advisory Committee Act of 1972.

As such, the charter was withdrawn.
