How does cmte accomplish its purpose?*The Committee will provide advice, information, and recommendations on the operation of the Office of Worker Advocacy, focusing on its case mangement and physician panel processes. The duties of the committee are solely advisory and are stated in the paragraph above. Recommendations to the Secretary will only be made with the concurrence of a majority of the members.
How is membership balanced?*Committee members will be selected to ensure an appropriately balanced membership among various stakeholders, institutional affiliations and geographical locations in accordance with the requirements of the Federal Advisory Committee Act.

Why advice can't be obtained elsewhere?*The Committee's charter will focus on the operation of the Office of Worker Advocacy (OWA) and its implementation of the Energy Employee Occupational Illness Compensation Program Act (EEOICPA)Subtitle D, including OWA case management and the operation of the physician panels. There is no advisory committee within the Department or the Federal Government that possesses sufficient experience to provide the Department with informed advice on policies and procedures related to Department of Energy and contractor nuclear workers who have suffered work-related illnesses. The solicitation of advice and information from the general public or constituent public through a variety of channels, will not satisfy the need for public input in lieu of establishing the proposed advisory committee.

Recommendation RemarksThe Worker Compensation Assistance Advisory Committee will terminate due to the Fiscal Year 2005 National Defense Authorization Act abolishes Part D of the Energy Employees Occupational Illness Compensation Program Act administered by the Department of Energy (DOE) and replaces it with a new system of federal payments called Part E to be administered by the Department of Labor (DOL).
