How does cmte accomplish its purpose?*no meetings FY2004The Committee serves in an advisory capacity. In the past, its recommendations to the managing agencies pertaining to mitigation, enhancement and other fish and wildlife programs for the Garrison Diversion Unit Project have been well received and implemented. The Garrison Diversion Unit Reformulation Act of 1986, PL 99-294, directs the Secretary of the Interior to acquire up to 5,000 acres in the Kraft Slough and Pickell Slough areas, because of their unique wildlife values, and to manage those acres as a part of the National Wildlife Refuge System. During this reporting period, the managing agencies continue to pursue opportunities for the land acquisition.
How is membership balanced?*Membership of the Council is balanced in accordance with requirements of the Charter. The legislation that established the Council, requires that the Incumbents of the following four positions, serve on the Council: (1) Regional Director, FWS: (2) Reigonal Director, Bureau of Reclamation;(3) Director of the North Dakota Game and Fish Department; (4) Commissioner, North Dakota Department of Agriculture. Additionally, three members from within the Statea of North Dakota and three members from outside the State of North Dakota serve on the Council.
How frequent & relevant are cmte mtgs?*The Council is scheduled to meet twice yearly or more frequently at the call of the Chairperson. Controversy pertaining to the project, prior to the passage of the 1986, Garrison Diversion Unit Reformulation Act, was so extensive that it severly impacted most Fish and Wildlife Service programs in North Dakota.The Council did not meet during FY 04, while awaiting appointment/reappointment of members and renewal of the Charter. It is anticipated that there will be no meetings in FY 05.
Why advice can't be obtained elsewhere?*This committee is needed to provide oversight for the Garrison Diversion Unit's mitigation, enhancement and other fish and wildlife programs associated with the project.Prior to the passage of the Garrison Diversion Unit Reformulation Act of 1986, that established the Council, there was significant, controvery in the State associated with wetland, waterfowl and mitigation issues. A lot of progress has been made regarding these issues. The Council has been effective by studying the issues,making recommendations to the managing agencies and, to date, there has been no necessity for elevating needed changes to the Secretary of the Interior and Governor of North Dakota for resolution.

Recommendation RemarksTerms for members have expired. Nominations for members have not been received from outside entities. In coordination with partners on the Council (Bureau of Reclamation, North Dakota Department of Agriculture, and North Dakota Game and Fish, it is recommended that the Council be terminated.

The meeting was informational, and there was agreement by the committee members to continue with projects to mitigate and enhance fish and wildlife resources relative to Garrison Diversion Unit activities. Agencies continue to carry out these activities. The Audubon (refuge) mitigation project is scheduled for completion in FY 06, the Arrowwood mitigation project is scheduled for completion in FY 07, and mitigation for State Wildlife Areas is complete with the purchase of the last tract to mitigate habitat losses that occurred at Audubon State Wildlife Management Area.

Partnerships with the Bureau of Reclamation and North Dakota Fish and Game have been strengthened by this committee by providing a forum to resolve conflicts, develop common objectives, and work together to meet those objectives.
