How does cmte accomplish its purpose?*The RSPA Negotiated Rulemaking Committee is developing a Notice of Proposed Rulemaking (NPRM) on the qualification of personnel performing certain safety-related functions on pipelines subject to the pipeline safety regulations. The Committee is developing the proposal through a negotiation process. this process brings all affected interests together to jointly develop a rule that will address the concerns of all affected parties.Together, thie Committee has developed all elements of the NPRM. OPS has combined all Committee input and provided them with a draft NPRM for their review. The Committee hopes to conclude the negotiating process, and prepare the NPRM for DOT review and publication in the Federal Register. After receiving any public comment, the Committee will meet to prepare the final rule.
How is membership balanced?*The Committee is composed of gas pipeline operators, hazardous liquid pipeline operators, state and federal government, labor organizations, emergency response representatives and other interested parties from the public sector. This group provides a wide range of interests from government, industry, and the public. All organizationsare allowed one seat at the negotiating table, and a facilitator acts as chair of the Committee, to ensure all perspectives are brought to the table.
How frequent & relevant are cmte mtgs?*The Committee meets about every six weeks. This allows for: 1) preparation and distribution of recorded minutes and other Committee documents; 2) adequate time for Committee review of these documents; and 3) interaction with members' constituency and preparation for the next meeting.
Why advice can't be obtained elsewhere?*This Committee was established to represent all interests affected by a rule on qualification of pipeline personnel. Other perspectives and opinions are brought forward during the comment period, scheduled at each Committee meeting. Committee members can bring any material they choose to the negotiating table. OPS believes this process was best for all sources of information regarding this issue.
