How does cmte accomplish its purpose?*The No Surprises Act, enacted as part of the Consolidated Appropriations Act of 2021, required the establishment of the State All Payer Claims Databases Advisory Committee (SAPCDAC or Committee) to advise the Secretary of Labor regarding the standardized reporting format for the voluntary reporting by group health plans to State All Payer Claims Databases, and on the guidance provided to States on the process by which States may collect such data in the standardized reporting format. The Committee's mandating statute required it to submit a report to the Secretary, the Senate Committee on Health, Education, Labor, and Pensions; the House Committee on Energy and Commerce, and the House Committee on Education and Labor that includes recommendations on the establishment of the format and guidance no later than 180 days from the date of enactment of the Consolidated Appropriations Act of 2021, with a due date of June 25, 2021. The statute provides that the Committee sunsets the day on which it submits its report to the Secretary and Congress.
How is membership balanced?*The Committee's membership balance requirements were prescribed by its mandating statute, which required the appointment of fifteen members, including a Committee chair, members from various federal agencies, public members, and a state representative. The statute required the Labor Secretary, in coordination with the Health and Human Services (HHS) Secretary, to appoint seven members. The statute required the Comptroller General to appoint six members of the public. The Employee Benefits Security Administration Assistant Secretary and the HHS Planning and Evaluation Assistant Secretary, or their designees, served as ex officio members.

Members were distinguished in fields of health services research, health economics, health informatics, data privacy and security, the governance of State All Payer Claims Databases, or represent organizations likely to submit data to or use the database, including patients, employers, employee organizations that sponsor group health plans, health care providers, health insurance issuers, or third-party administrators of group health plans.

Recommendation RemarksThe SAPCDAC's mandating statute provides that it will sunset the day on which it submits its report to the Labor Secretary and Congress. The Committee submitted its report on October 19, 2021. As such, the SAPCDAC sunsetted in Fiscal Year 2022.
