How does cmte accomplish its purpose?*Pursuant to section 8115(a) of the FY 2023 NDAA, the Committee will develop and make recommendations on activities and actions that should be undertaken by the U.S. Army Corps of Engineers (USACE) to ensure more effective delivery of water resources development projects, programs, and other assistance to Indian Tribes and economically disadvantaged communities, including economically disadvantaged communities located in urban and rural areas. Pursuant to section 8115(d) of the FY 2023 NDAA, any recommendations made by the Committee to the Department of Defense (DoD) will reflect the independent judgement of the Committee.
How is membership balanced?*Pursuant to section 8115(b) of the FY 2023 NDAA, the Committee shall consist of 10 members, who must have the requisite experiential or technical knowledge needed to address issues related to the water resources needs and challenges of economically disadvantaged communities and Indian Tribes.
Consistent with section 8115(e)(3) of the FY 2023 NDAA, members of the Committee shall not be considered to be federal employees, and therefore, each member shall be appointed as a representative member in accordance with 41 C.F.R. § 102-3-130(a). The members are expected to represent and speak on behalf of the interests, views, or biases of a recognizable group of persons or class of stakeholders.

Pursuant to sections 8115(b)(1) and (2) of the FY 2023 NDAA, the Committee shall be composed of the following members:

a. Five individuals representing organizations with expertise in environmental policy, rural water resources, economically disadvantaged communities, Tribal rights, or civil rights; and
b. Five individuals, each representing a non-federal interest for a Corps of Engineers project.
How frequent & relevant are cmte mtgs?*Pursuant to section 8115(c)(2) of the FY 2023 NDAA, the Committee shall meet as appropriate to develop and make recommendations. The committee was not active in FY25 and did not meet. Per the TEDCAC Charter, the committee, once active, shall meet twice per year.

Why close or partially close meetings?Meetings are not closed to the public unless the DoD determines that items on the planned agenda meet the closed meeting provisions of 5 U.S.C. § 552b(c). Pursuant to DoD policy closed meetings can only be authorized by the DoD Sponsor, the Secretary of the Army, and only after consultation with the Office of General Counsel for the Department of the Army.

b. integrating consideration of economically disadvantaged communities and Indian Tribes, where applicable, in the development of water resources development projects and programs of the USACE; and
c. improving the capability and capacity of the workforce of the USACE to assist economically disadvantaged communities and Indian Tribes.
