How does cmte accomplish its purpose?*The WWCC, consistent with section 8158(a)(5) of the NDAA for FY23, shall develop and make recommendations to avoid or minimize conflicts between the operation of USACE projects and the water rights and water laws of Western States. However, in carrying out its duties, the WWCC shall make recommendations that only apply to Western States; and shall ensure that any recommended changes or modifications to policy or regulations for USACE projects would not adversely affect water resources within the State of Missouri.
How is membership balanced?*Consistent with section 8158(a)(3) of the NDAA for FY 2023, the WWCC shall be composed of: (A) The Assistant Secretary of the Army for Civil Works (or a designee); (B) The U.S. Army’s Chief of Engineers (or a designee); (C) One representative from each of the 18 Western States, who may serve on the Western States Water Council, to be appointed by the Governor of each State; (D) One representative with legal experience from each of the 18 Western States, to be appointed by the Attorney General of each State; and (E) One employee from each of the impacted regional offices of the Bureau of Indian Affairs (BIA), as determined by the BIA.
How frequent & relevant are cmte mtgs?*The WWCC shall meet at the call of the WWCC’s DFO, in consultation with the WWCC Chair and the Secretary of the Army. Consistent with section 8158(a)(4)(A) and (B) of the NDAA for FY 2023, the WWCC shall meet not less than once each year in one of the Western States and each meeting of the WWCC shall be open and accessible to the public.
Why advice can't be obtained elsewhere?*The Secretary of Defense, pursuant to section 8158(a)(1) of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023 (Public Law 117–263) (“the NDAA for FY 2023”) and in accordance with chapter 10 of title 5, U.S.C. (commonly known as the “Federal Advisory Committee Act” or “FACA”) and 41 C.F.R. § 102-3.50(a), established this non-discretionary Federal advisory committee.
Why close or partially close meetings?Meetings are not closed to the public unless the DoD determines the items on the planned agenda meet the closed-meeting provisions of 5 U.S.C 552(b)(c). Pursuant to DoD policy, closed meetings can only be authorized by the DoD Sponsor, the Secretary of Army, and only after consultation with the Office of Army General Council.
Recommendation Remarks31 of the 48 members were approved or affirmed by the Secretary of Defense in June 2025. The remaining members will be submitted for approval in a supplemental membership package in early FY 2026. The nomination letters for the State members do not include language about the term of service on the WWCC. One virtual meeting was held in FY25 on September 4, 2025. The meeting announcement was publicized in the Federal Register and open to the public.
