How does cmte accomplish its purpose?*Introduction
The Regulations and Procedures Technical Advisory Committee (RPTAC) is pleased to provide the following Annual Report for FY2025 and the Annual Plan for FY2026. During 2025 the RPTAC worked primarily through its existing work groups.
The current RPTAC work groups are:
Compliance, Enforcement, Regulatory Clarity:
Maintains a dialogue with the Office of Export Enforcement (OEE) and provides feedback on Voluntary Self Disclosure and General Prohibition 10 processes, export licensing and cross-agency deconfliction.

Computing, Encryption, Data Security:
Studied ways to simplify U.S. regulations relating to encryption and monitors differences between the U.S. and other Wassenaar countries in the implementation of encryption regulations. The work group also addresses the Executive Order on Malicious Cyber/Crypto, and the increasing regulations on microelectronics.

Plurilateral Controls, Sanctions:
Addresses regulatory issues arising from multilateral control regimes such as Wassenaar, the Australia Group, the Nuclear Suppliers Group, the Missile Technology Control Regime and the Organization for the Prohibition of Chemical Weapons, and the EU-US Trade and Technology Council (TTC). In addition to providing BIS with input during the development of U.S. proposals for the different regimes, this work group also monitors the implementation of agreed upon changes in the regulations, Multi-jurisdiction Licensing, and the Foreign Direct Product Rule.

U.S. Person, End-user, End-Use Controls:
Is concerned with Military End Use/End User rules, CHIPs Act, the regulations and licensing policies and procedures that relate to the control of technology, such as the deemed export/reexport rule, technology transfers and U.S. person controls.

Supply Chain:
Is concerned with export clearance issues, the AES system, Antiboycott, Human rights/forced labor, and the Information and Communication Technology and Services Executive Order implementation related to the Export Administration Regulations.

Most of the BIS briefings and virtually all of the comments and proposals submitted by the RPTAC are developed under the auspices of the work groups. Under our current structure the individual work group chairs act as the issue managers for subjects that come under the purview of their respective groups. The chairperson of each group organizes work group meetings as needed, ensures that comments and proposals are drafted and circulated to the full committee for review, and leads the discussion for their group’s subject area during quarterly meetings of the full committee. This method of organizing the Committee’s efforts results in the ability of the RPTAC to efficiently review and comment on regulation changes and to develop multiple proposals in parallel.

Recommendations, Accomplishments and Work Group Activity
The work of the Committee during FY25 included providing comments on pending and proposed regulations and BIS initiative, advancing proposals for improving the efficiency and effectiveness of various procedures, and meeting with members of the BIS management team to provide briefings on issues before the RPTAC.
In FY 2025, the RPTAC’s key accomplishments included review, comments and recommendations concerning the following regulations, topics, and initiatives (letters and e-mails to U.S. Government officials referenced where applicable):

Provided comments on AI/SME related rules.

In addition, the RPTAC provided feedback on the following topics in closed session at quarterly RPTAC meetings:

-Semiconductor Manufacturing Equipment and AI Chip Regulations
-Standards Bodies
- AES and Census/BIS Routed Export Rules/NPRM FTR requirements for capturing the USPPI of in-transit movements and requirements to report the entry number for foreign origin exports
- Interim Rule on Implementation of Plurilateral Controls, Consensus
-BIS Office of CIO on website changes
- Internal Compliance Program Guidelines
Objectives and Plans for FY 2026
Plans for FY 2026 will focus on continuation of the established work groups and their respective initiatives. The RPTAC and Work groups will continue to meet between the full committee meetings as needed in order to further their objectives and to provide timely comments, recommendations, and proposals to BIS.
How is membership balanced?*The RPTAC is composed of industry representatives, and U.S. Government agencies with specific technical or export control expertise in the area of export control administration. Individuals from large and small firms throughout the U.S. are represented on the Committee.
How frequent & relevant are cmte mtgs?*The RPTAC met four times in FY 2025: December 10, 2024; October 15, 2024; June 10, 2025; and September 9, 2025. The meetings allow the RPTAC to advise on the implementation and administration of current export control initiatives. Attendance by Committee members, government and the public was strong at all of the meetings.
Why advice can't be obtained elsewhere?*The RPTAC provides the Department with technically qualified individuals possessing a broad range of expertise in the area of export control administration. There are no other known sources within the Government that reflect this depth and range of expertise.
Why close or partially close meetings?Closed sessions are held to allow for discussion of information classified for reasons of national security, information the premature disclosure of which would be likely to significantly frustrate implementation of a proposed agency action, or information of a commercial or financial nature that is privileged or confidential.
Recommendation RemarksAuthorized by the Export Control Reform Act of 2018 (ECRA) (50 U.S.C §§ 4801-4852), the Export Administration Regulations (EAR) (15 C.F.R. Parts 730-774), and the provisions of the Federal Advisory Committee Act, as amended (FACA), (5 U.S.C. § 1001 et seq.).
