How does cmte accomplish its purpose?*Much of the authority of the President under the Convention on Cultural Property Implementation Act has been conveyed via executive order (E.O. 12555 of March 10, 1986) and subsequent legislation to the Secretary of State, and now also rests with certain senior officials at the Department pursuant to delegations of authority. The government of any State Party to the 1970 UNESCO Convention may request a cultural property agreement by submitting a written request to the Department of State. On receiving a request, the Department will refer the matter to the Cultural Property Advisory Committee (CPAC) for its recommendations and views. In making its recommendations, the CPAC takes into consideration the foreign government’s request and supporting documentation, as well as information that may be available from other sources. These sources include, but are not limited to, individuals, academic and scientific organizations, the United States government, intergovernmental organizations, and non-governmental organizations with recognized expertise in the subject matter. Public comment, while not required, may also be solicited.
How is membership balanced?*The Committee has balanced representation as required by the Cultural Property Implementation Act Section 306 (b) (1-2): the Committee includes two members who represent the interests of museums; three members who are expert in archaeology, anthropology, ethnology, or related fields; three members who are expert in the international sale of cultural property; and three members who represent the interest of the general public. Appointments to the Committee are made by the President, not by the agency.
How frequent & relevant are cmte mtgs?*The Committee typically meets three to four times a year depending on the number of new requests from foreign countries and proposed extensions of cultural property agreements or emergency actions. The meeting dates and agenda are published in the Federal Register.
Why advice can't be obtained elsewhere?*The Committee is established by statute.
Why close or partially close meetings?The Cultural Property Implementation Act, Section 306(h) exempts the Committee from open meetings whenever and to the extent it is determined by the President's designee that the disclosure of matters involved in the Committee's proceedings would compromise the government's negotiating objectives or bargaining positions on the negotiations of any agreement authorized by this title.
Recommendation RemarksThe Committee provides advice regarding U.S. implementation of the 1970 UNESCO Convention on the Means of Prohibiting and Preventing the Illicit Import, Export, and Transfer of Ownership of Cultural Property, as implemented by the Cultural Property Implementation Act (19 U.S.C. §§ 2601-2613, "the Act"). Under the Act, if certain conditions exist, the United States can either enter into an agreement or use emergency action to respond. The Committee provides expert advice on whether the statutory conditions exist. The Department of State negotiates bilateral agreements. The Department of the Treasury and U.S. Customs and Border Protection publish import restrictions in the Federal Register.
Members are appointed for three-staggered terms and serve indefinitely until they are replaced. While the meeting dates of 1/30/2024, 6/4/2024, and 9/24/2024 were open to the public, information pertaining to the same which is not of a proprietary nature may be available by contacting the DFO.
