How does cmte accomplish its purpose?*The Board is appointed by the Secretary of Agriculture and answers to the Secretary of Agriculture through the meeting minutes. Recommendations are voted upon and simple majority carries the motion.
How is membership balanced?*The membership includes farmer representation and is drawn approximately equally from the private or seed industry sector and from the sector of the government or the public.
How frequent & relevant are cmte mtgs?*The Board meets as needed by teleconference or in-person. Updates on program operations are provided to the Board as needed. Special meetings may be called if the Secretary of Agriculture requires more immediate advice.
Why advice can't be obtained elsewhere?*The Board is mandated by Congress in 7 U.S.C.2327. The Board is required to advise the Secretary of Agriculture on matters concerning adoption of Rules and Regulations, appeals of decisions of examiners and on questions of declaring varieties open for public use in the times of national emergency.
Why close or partially close meetings?Meetings are open to the public. However, certain agenda items may be closed to the public if confidential material from individual applications is being presented to the Board for their consideration.
Recommendation RemarksThe PVPO will be increasing outreach efforts. A broad search was undertaken for nominees from identifiable minority groups with the required expertise in variety development using emails or letters sent to all 1890 and 1860 colleges and universities, to Hispanic-Serving and Native American-Serving (1994) Institutions, and state research and extension programs serving small farmers. Emails will also be sent to professional societies, including societies specifically fostering advancement of minority scientists. All oral and written contacts will specify that nominees are sought who possess "demonstrated ability to represent minorities, women, and persons with disabilities". The PVP Board does not create an annual report, instead the minutes of the meeting are generated by the PVP staff and are approved by the Board members.

Agency Feedback Comment*Updates are sent to PVP Board members as needed and feedback is provided by PVP Board members if an issue of concern arises. There are no pending issues at this time and no comments from PVP Board members. The charter has been renewed and the PVP Board nomination package is under review by the Secretary. New members are expected to be appointed by January 2025. A PVP Board meeting is tentatively scheduled for the spring of 2025.Narrative Description*The duties of the Board are to: (1) advise the Secretary concerning the adoption of rules and regulations to facilitate the proper administration of the Act; (2) make advisory decisions for the Secretary on appeals concerning decisions on applications by the Plant Variety Protection Office and on requests for emergency public-interest compulsory licenses; and (3) advise the Secretary on any other matters under the rules and regulations.
