Agency Feedback Comment*N/ANarrative Description*The Burley Tobacco Advisory Committee (BTAC) was a discretionary committee to assist the Secretary of Agriculture in providing inspection services in an equitable manner to all producers and promote an orderly marketing system for burley tobacco. The BTAC met on a regular basis to review and make recommendations on marketing regulations, opening and closing dates for auctions and receiving stations, assignment of tobacco inspectors, and annual selling schedules for burley tobacco to be sold each year. The Secretary of Agriculture had the responsibility for providing mandatory tobacco inspection services at designated auction markets under the Tobacco Inspection Act (7 U.S.C. 511-511q) and non-auction tobacco under the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act for 2002 (Appropriations Act). Pursuant to the requirements of section 759 of the Appropriations Act, referenda were conducted among producers of each type of tobacco to determine whether they favored mandatory grading of all tobacco by the U.S. Department of Agriculture (USDA). A majority of producers who voted in the referenda favored mandatory grading and regulations were implemented May 24, 2002. With the adoption of mandatory grading of all tobacco, except cigar types, approximately 98 percent of tobacco marketed required Federal grading for the 2002 and subsequent crop years. Without said inspection services, no tobacco could be sold. The BTAC proved to be an effective instrument in assisting the USDA in the performance of its regulatory responsibilities in the marketing of burley tobacco. In addition to recommending opening dates and selling schedules, the BTAC enabled the Secretary of Agriculture to establish policies and procedures for the marketing of burley tobacco. The functions of the BTAC were in the public interest and strengthened the program and aided the USDA in equitably administering tobacco inspection services.
